Terms and conditions of sale
ARTICLE 1: SCOPE
These general terms and conditions of sale apply to all sales concluded through our website.
ARTICLE 2: ORDERS
Automatic recording systems are considered proof of the nature and content of the order. Our brand confirms the acceptance of the order to the customer via the email address they provided. The sale will be concluded upon the validation of payment by our brand, which is either the date of payment validation for orders paid online by credit card or the date of receipt of payment by check. Our brand reserves the right to refuse or cancel any order from a customer with whom there is a dispute related to payment of a previous order.
ARTICLE 3: AVAILABILITY OF ITEMS
As long as our offers and prices are visible on the site, they are valid. The availability displayed at the time of consultation by the customer remains dependent on stock levels with our brand and, of course, our suppliers.
To showcase our catalog and sale offerings, we work with databases enriched with information provided by our suppliers. Since this database contains over a hundred items, not all items are stocked in our reserves, so our offer depends on the availability of items from suppliers.
Only a permanent stockout from suppliers results in the removal of the item from our sales offer. In other cases, new orders may be possible within a certain timeframe.
When an item in a customer’s order is unavailable, the customer will be notified by email or on the invoice for shipped products in the case of an order containing multiple items.
Order delivery deadline: when placing an order and in the order confirmation, a delivery time is provided to the customer. This time is calculated by adding the availability period of the longest-lead product to the transport time of the selected delivery method.
From the time the order is placed to its shipment, the customer may cancel the order.
Special Cases:
Pre-order items: items to be released are offered on our site for pre-order. This reservation is made with the expected release date announced by the publisher at the start of the pre-order period. This release date may change at any time by the publisher, who is solely responsible for marketing their product.
In all cases, our brand strives, as soon as the final sale date arrives, to ship items to customers who reserved them, up to the stock quantity provided by the publisher for the release date.
ARTICLE 4: PRICES
Prices listed in euros are net, excluding shipping. The price includes the cost of products, handling fees, packaging, and product preservation. Prices are subject to change at any time without notice; however, items will be billed based on rates in effect at the time the order is placed. All orders are invoiced and payable in euros. Any customs or local taxes are the responsibility of the recipient.
ARTICLE 5: SHIPPING FEES
Shipping fees include a contribution toward preparation, packaging, and postage costs. Please group all your items into a single order. We cannot consolidate two separate orders, and shipping fees will apply to each.
ARTICLE 6: PAYMENT
You have several payment options offering maximum security guarantees. You can pay:
– By credit or private card (Visa, Eurocard/Mastercard) directly on the site using the payment form provided during the ordering process (secure entry through SSL encryption), by entering the card type, number (without spaces), control number (located on the back of your card), and expiration date.
Different payment methods are available, and you can even opt for credit card payment facilities.
Payment is made on our partners’ secure banking servers. This ensures no banking information about you transits via our site.
Credit card payment is therefore fully secure; your order will be recorded and validated as soon as the bank accepts payment.
ARTICLE 7: DELIVERY
We deliver to your home or a relay point. The delivery time includes package preparation time plus shipping time. Our brand delivers worldwide. The buyer is notified by email of each step of the order’s progress: preparation and shipment.
The delivery time includes preparation and shipping by our carrier (10 days to 3 weeks). The delivery time announced by the delivery service does not commit us if the time is exceeded. However, the customer service team will do their utmost to meet customer expectations. The delivery time announced by the carrier does not bind our brand to a longer deadline.
ARTICLE 8: WARRANTY – RETURNS – REFUNDS – WITHDRAWAL
Items provided by our brand are new and guaranteed against any defect. They are identical to those in traditional stores and come from all referenced publishers and suppliers.
Should an item be defective or non-compliant, the buyer has 15 working days from receipt to request an exchange or refund. If the fifteen (15) day period ends on a Saturday, Sunday, or public holiday, it is extended to the next working day.
The customer must return the items, new or unused, in their entirety and in their original packaging, intact, along with any accessories, instructions, and documentation (in its original cellophane packaging, if applicable, and with the corresponding invoice). In such a situation, the buyer must send proof of the defect(s) to our brand (description and attached photos).
In case of withdrawal, our brand is obligated to refund amounts paid by the customer, excluding return fees. The refund is due within a maximum of 14 business days from the date of receipt of the returned package(s).
Return shipping costs remain the customer’s responsibility.
For refunds, we guarantee it will be processed within 14 days from the date of receipt of the returned package. No cash-on-delivery return will be accepted for any reason.
ARTICLE 9: TRANSFER OF OWNERSHIP – TRANSFER OF RISK
Ownership of products transfers to the purchaser only after full payment of the price, regardless of the delivery date. However, the risk of loss and damage to products transfers upon delivery and receipt by the buyer.
ARTICLE 10: PROTECTION OF YOUR PERSONAL DATA
Our brand is the producer and owner of all or part of the databases comprising this site. By accessing this site, the customer acknowledges that the data it comprises is legally protected and agrees not to extract, reuse, store, reproduce, represent, or retain, directly or indirectly, on any medium or by any means, all or a substantial part, qualitatively or quantitatively, of the content of the databases on this site.
ARTICLE 11: LIABILITY
Product descriptions in our brand’s databases were entered based on information provided by publishers. Our brand is not responsible for the content of works and cannot be held liable to the buyer. Our brand cannot be held liable in the event of force majeure (strike, flood, fire…).
The products offered comply with the laws of Hong Kong. Our brand declines all responsibility if the delivered item does not comply with the laws of the delivery country (censorship, title or author ban…). Our brand is not responsible for the content of sites to which hyperlinks on its own site may redirect.
ARTICLE 12: APPLICABLE LAW
All clauses in these general terms of sale, as well as all purchase and sale operations referred to therein, will be subject to Hong Kong law.
ARTICLE 13: BUYER’S ACCEPTANCE
These general terms and conditions of sale, as well as the rates, are expressly agreed to and accepted by the buyer, who declares and acknowledges having full knowledge of them, and thereby waives the right to rely on any contradictory document, including their own general terms of purchase. The act of purchasing constitutes acceptance of these general terms and conditions of sale.
ARTICLE 14: CHILD SAFETY
We are not responsible for drowning or other risks; you must supervise children when they are near or in the water. We offer a blog article on learning to swim with a mermaid tail that may help, but under no circumstances should children be left unsupervised. Be responsible; an accident can happen quickly.
